Dealing with the post-holiday heartache

PEOPLE facing troubles in their marriages are being encouraged to talk to a professional about their options.

Experienced family lawyer Alan Peck, Equity Partner at leading regional law firm Tollers, believes individuals are facing an information overload.

Traditionally inquiries rise after a holiday and this Christmas and new year have been no exception.

Alan, who has more than 25 years’ experience, said: “We believe it is important for people to know their options and get a view from a professional about the possible outcomes.

“For some it could be that they know there are problems in their marriage and want to discuss what might be the likely options. They may go away and we may never see them again or they may come back in two, three or even eight months.

“Others may find the meeting gives them confidence to sit down and talk about the situation with their partner while others may decide on mediation.

“At no stage are we there to tell them what to do but simply to suggest what they will need to consider. The knowledge can give them the confidence when it comes to taking decisions.”

Often clients have more than the future of their marriage and arrangements for children to consider. Husband and wives have shares in a family business, have a directorship and will need to discuss distribution of assets.

Alan said: “There can be issues like taxation which need to be considered and what are the implications if a decision is taken to end the marriage. Once people are aware of all the issues they often tell us they feel empowered and in better control of their futures.”

The first consultation usually takes about an hour and extensive notes will be taken.

Alan said: “Clients have an option to talk to a male or female lawyer, which can be important for some people. We take notes so if they choose to return we do not have to go over old ground but can bring us up to date with the current situation.

“We respect each client’s privacy and they can rest assured that what is discussed in the meeting will remain confidential unless they make a request for further steps to be taken.”
