When a festive break provokes a marital split

THE festive season, can spell the end of strained relationships, but there are ways to make divorce and family breakdown less painful and protracted comments Jane Cowley Family Law Partner at Howes Percival LLP.

Christmas is not always full of good cheer and goodwill to all. Add to the mix unrealistically high expectations, financial pressure, alcohol, and entertaining extended family, and strain is inevitable.

Almost half of marriages result in separation and divorce, and amongst those numbers there is a whole spectrum of family breakdown running from bitter and protracted to amicable, fair and quick. Seek advice from a Resolution approved lawyer, and if you both desire an amicable settlement, then consider collaborative law. This allows you to keep in control. Each party instructs their own collaborative lawyer. All parties and lawyers work together, and deal with matters face to face in a positive and constructive manner. Meetings will be focused on your agenda, and what you wish to see happen and when. As you will both be embarking on your new lives, you can do so free of the scars that can be left from a confrontational and unnecessarily expensive and painful divorce.

Divorce is of course always a challenging time for children but the knowledge that their parents have worked hard together, to find a way forward, during the most difficult of circumstances, can be truly reassuring and comforting.
